Additional Methods of Enforcement

In addition to enforcing your judgment through the Sheriff's Office, the District Court, or through a Judgment Mortgage, there are other legal methods that you may use to recover the debt owed to you.

These additional methods include:

  • An Attachment of a Debt or Garnishee Order. This is sometimes known as a 'third-party debt order'. This means that you, the claimant, is owed money by the respondent, but the respondent is also owed money by a third person. Using this order, the third person is ordered to pay you in order to clear the respondent's debt. Generally, it is only used in cases where there are no goods to be seized.
  • Appointing a Receiver. In this case, a court can order that a respondent's assets or future income is paid to you by the receiver. Examples of assets or future income may include income from rent, a trust fund, or a pension. 
  • Bankruptcy. You may apply to have the respondent declared bankrupt if certain conditions are met. For more information on this, please see our bankruptcy page.
