Circuit Court ADMC forms

This form is used to outline a sworn statement setting out that a document has been served, where, how, when and by whom on the Relevant Person. It is also used to indicate what their response was, if any, at that time.

This form is used to outline a sworn statement to support a Capacity Application to the Circuit Court setting out any attached exhibits such as any medical or other report or copy of the consent order if appropriate.

This form is a sworn statement setting out that a document has been served, where, how, when and by whom on a Notice Party. 

Capacity Application Form 55A

This form is used to make a Capacity application in the Circuit Court.

This form is used for a court application where only one party needs to be aware of the application and be present in court. If you are not included on the defined list of people who can make a capacity application, you will need to use this form to apply to the Circuit Court for consent (permission).

This form is used to file an appeal against a decision made by the Director of the Decision Support Service.

Note: This appeal will be heard in the Circuit Court.

This form is used for a written application for an order from the court under the Assisted Decision Making (Capacity) Act, 2015. 

Note: This form is not used to make a Capacity Application, Consent Application or an Appeal.

This form is used to officially reply to a Capacity Application. 

This form is used to reply to a Notice of Motion. It can be used by any party to the case.

This form is used to provide details to support your Capacity Application to the Circuit Court.

Capacity Statement (Assessment)

This template can be used by a healthcare professional when completing a functional test of capacity. A capacity Application cannot be made without this assessment.
