What happens if someone breaches an order
Breaching a civil restraining order means breaking any of the terms or conditions set out in the order. This is a criminal offence.
If someone is charged with breaching a civil restraining order, the case will be heard in a criminal court.
What you can do if this happens
If you have been given an order and the person you have taken the order out against (the respondent) breaks it, you should:
- Immediately call the Gardaí
- Show the investigating or responding Garda(í) a copy of your order
- Listen to the Garda(í) and follow their instructions on what to do next
