Information you need to make your small claims application

When you are making your small claims application, it is important that you include specific details about your claim. You should gather the information below to help you make your small claims application.

1. Your personal details as the claimant

Your name, address, email and phone number.

2. Details of who you are claiming against

You need to have the correct details of the person or business you are claiming against. If you do not, it may lead to your application being rejected or a successful claim not being enforced.

  • If your claim is against a sole trader you should include their name and registered business address (this could be their home address).
  • If your claim is against a company you should include:
    • Their company name and the name that they trade under (also called the legal entity).
    • Their company address.
    • Their Company Registration Office (CRO) number. To find this information you should contact 018045200 or you can search the CRO website.
  • If your claim is against another person, you should include their full name, address and contact details.
  • Both you and the person or business that you are claiming against must be based in the Republic of Ireland.

3. What happened that lead to your claim

You will need to explain what your claim is about. You should prepare all the facts about your claim and include:

  • Details about what happened and when it happened.
  • Full description of the problem with the good or service.
  • Full description of the damage to your property.
  • Any correspondence you have had with the respondent.
  • Evidence to support your claim (for example a quote for repair, receipts).

4. How much you are claiming for

You should include the amount that you are claiming for and explain why you are claiming that amount. You should have evidence to support this amount for example receipts. It is important to know that:

  • You can only claim the value of the product, service, damage or deposit.
  • The value of your claim must be €2,000 or less.
  • You cannot claim for time spent, distress or any costs related to making your claim, this includes the €25 application fee.
